Unfortunately, litigation is a common, if not inevitable, part of doing business. It is essential to have an experienced litigator in your corner to help navigate through the complex process. Alternative Dispute Resolution (ADR) and Settlement Negotiations

Becoming embroiled in litigation can not only become expensive, but it can also be stressful and burdensome. It likewise can be time-consuming, distracting litigants from ongoing personal and business concerns. Statistically, of course, the vast majority of cases settle prior to trial. It is equally true that cases are won or lost long before the litigants ever step into the courtroom. Clients of the Firm can count on our frank analysis of the strengths and challenges of a client’s case, as well as our ability to strategize and position a case so as to capitalize on the weaknesses of the opponent’s case and to expose the opponent’s vulnerabilities to the maximum extent possible. The Ross Law Firm has the depth of litigation experience necessary to create the litigation environment within which a truly advantageous settlement can occur.

In a limited number of circumstances, in fact, it is possible to resolve a dispute on favorable terms even before it escalates into litigation. In these cases, the Ross Law Firm explores this possibility in order to conserve client resources.

Due to the costs and risks our clients face in litigation, we also explore alternative dispute resolution opportunities, such as mediation, on behalf of our clients. Alternative dispute resolution, moreover, is not necessarily a matter of choice. Courts often encourage if not require litigants to participate (in good faith) in mediation (presided over by a neutral, third party mediator who practices “shuttle diplomacy” to explore mutually satisfactory solutions). Binding arbitration (where the arbitrator’s decision has the effect of a court judgment) can also be the exclusive remedy available when imposed contractually by virtue of a valid, mandatory arbitration clause.
